Right to Homeschool Children under Attack in California

(Publisher’s Note:  Supreme Court Justice Alito recently said from the bench in a Supreme Court case that we are entering a period of time where religious liberty is going to be in jeopardy.  This is because of a recent case that the Court upheld a District Court decision and because of the recent death of Justice Scalia.  If he had been alive the case would have no doubt been decided in favor of religious liberty, 5-4, overturning the lower court case.)

The Home School Legal Defense Association (HSLDA) has reported that the right to homeschool children is under attack in California.


HSLDA reports that its members in the San Benito High School District recently received a letter stating, “[U]nder California Law, a home school is not a private school, nor is it a lawful alternative to public school…”


Homeschool advocates were confused as to why this letter was sent because back in 2008, a court case had already established that homeschooling was legal in California.


That case, known as Jonathan L. ultimately concluded, after a pro-homeschooling coalition stated their case, that homeschooling was permitted in California under the designation of a private school.


“California statutes permit home schooling as a species of private school education,” said the ruling.


HSLDA questioned why the right to homeschool in California is now under attack once again. The organization encouraged homeschool advocates to join HSLDA and to continue to support the homeschooling movement.
